Terms of Service
1. Acceptance of Terms
By accessing or using NOX, you agree to be bound by these Terms of Service. If you are using NOX on behalf of an organization, you represent that you have the authority to bind that organization. If you do not agree to these terms, you may not use the service.
2. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized use. Accounts registered by automated methods are prohibited.
3. Service Description
NOX provides an autonomous virtual brain and cognitive extension platform that includes autonomous task execution, workflow automation, agent orchestration, and API integrations. We grant you a non-exclusive, non-transferable, revocable license to use the service during your subscription term. Service features may change with notice.
4. Usage Limits and Fair Use
Subscription plans include specific usage limits, including API calls, agent runtime, storage, and concurrent sessions. Excessive usage beyond fair limits may result in throttling or additional charges. We reserve the right to suspend accounts that exceed reasonable usage patterns.
5. Prohibited Activities
You may not use NOX for any illegal purpose, to generate harmful content, to bypass security measures, to reverse-engineer the service, to train competing AI models, or to violate others' intellectual property. Automated scraping or data mining of the service is strictly prohibited.
6. Intellectual Property
You retain all rights to the content you input into NOX. We claim no ownership over your data or outputs. NOX Intelligence's underlying technology, including algorithms, models, and interface designs, are the exclusive property of Falcone Intelligence Pvt. Ltd. and are protected by applicable intellectual property laws.
7. Payment Terms
Fees are billed in advance on a monthly or annual basis as selected. All payments are non-refundable except as required by law. We may change pricing with 30 days notice. Late payments may result in service suspension. Taxes are additional unless otherwise stated.
8. Service Level and Liability
We target 99.99% uptime but do not guarantee uninterrupted service. Our liability is limited to the fees paid in the 12 months preceding a claim. We are not liable for indirect damages, lost profits, or data loss. This section does not limit liability where prohibited by law.
9. Termination
Either party may terminate the agreement with 30 days written notice. We may immediately suspend access for violations of these terms. Upon termination, your data will be available for export for 30 days. Sections on intellectual property, liability, and dispute resolution survive termination.
10. Governing Law
These terms are governed by the laws of the Republic of India. Any disputes shall be resolved through binding arbitration in Mumbai, Maharashtra, in accordance with the Arbitration and Conciliation Act, 1996. Class actions and jury trials are waived to the extent permitted by law.
